Module 4: Reporting Workplace Harassment or Violence

GOALS

After completing this module you will understand:

  • The process for reporting an occurrence of workplace harassment or violence.
  • What needs to be in a Notice of Occurrence of harassment or violence.
  • What happens when a Notice of Occurrence is filed.
  • When there will be an investigation, how it will be conducted and what happens after an investigation.
  • How to report an employer who violates the Canada Labour Code.

Occurrences

Under the Workplace Harassment and Violence Prevention Regulations an incident of workplace harassment or violence is called an occurrence and is reported using a Notice of Occurrence.

After a Notice of Occurrence is Filed

After a Notice of Occurrence is filed certain steps must be taken.

Investigations

If the Notice of Occurrence is not resolved by negotiation or conciliation, the person who was harassed or experienced violence can require that the matter be investigated.

Compliance Complaints

Employees can make a complaint if their employer has not complied with the Canada Labour Code or its Regulations.
